EXP REALTY RIVIERA MAYA · Omar Chavez Rico · August 13, 2026

True wealth in the real estate sector is not built by buying a finished property, but by having the vision to acquire it when it is still a promise on paper. Identifying the best real estate pre-sales 2024 was the first strategic step for those who today, in 2026, see their assets consolidated with capital gains that in high-demand areas have reached projections of up to 14% annually. This window of opportunity is not a matter of luck, but of a deep analysis of the market and its trends.

You probably share the concern of many investors about timely deliveries or hidden legal risks in contracts. It is natural to feel that calculating the real return on investment is a challenge given the complexity of the current environment. However, we are convinced that the protection of your capital must be the absolute priority. In this guide, you will discover how to identify opportunities with the highest capital gains and secure your assets with the backing of expert advice.

We will explore the most competitive payment facilities, such as the 30/70 scheme, and the legal keys to acquiring luxury apartments at preferential prices. We will analyze the investment map that will allow you to transform uncertainty into tangible and secure profitability for your future.

Why do real estate pre-sales continue to lead the market in 2026?

The real estate market in Mexico has shown exceptional resilience, consolidating itself as the preferred refuge for those seeking to protect their capital against inflation. Investing in early stages allows capturing the value of the asset before the project becomes a physical reality. Those who knew how to identify the best real estate pre-sales 2024 today enjoy properties that have significantly increased in value even before receiving the keys. It is not simply about buying a property; it is about acquiring time and capital gains at a preferential price.

There is a technical distinction that every sophisticated investor must master: the difference between the "zero list" and the final pre-sale. In the zero list phase, you enter the project before its public launch, obtaining the lowest possible cost per square meter. The final pre-sale, although offering greater visual certainty about the construction progress, entails a smaller profit margin. Understanding these stages is vital to replicate the historical returns we have observed in high-end residential developments over the last two years.

Liquidity is the fuel of any intelligent asset strategy. For this reason, opting for a real estate pre-sale with payment facilities is crucial for cash flow. These schemes allow you to diversify capital without decapitalizing, paying deferred down payments while the property organically gains value during construction.

Financial advantages of early acquisition

Immediate savings are the most tangible benefit. When buying in pre-sale, the price is usually between 20% and 30% below the final commercial value after delivery. To this, we add the construction capital gain, which is the increase in value that the building experiences as it surpasses structural milestones. Flexible terms, with interest-free monthly payments during construction, make it easier for your investment to work for you without compromising your immediate financial stability.

The impact of national infrastructure on ROI

Location is important, but connectivity and services are what truly drive the return on investment. Land value is directly linked to the real estate development process and investment in public infrastructure. The year 2024 marked a before and after with the inauguration of mass transit projects and industrial hubs in the north and southeast of the country. These works act as multipliers of profitability, ensuring that nearby residential developments maintain constant demand for both sales and luxury rentals in the long term.

Criteria for identifying the best real estate pre-sales 2024 and current

Investing with precision requires a technical compass. An attractive location is not enough; the success of your capital depends on a multidimensional evaluation that mitigates risks and enhances benefits. When analyzing the best real estate pre-sales 2024, we observed that the winning projects shared four fundamental pillars: developer solvency, location with consolidated services, high-level amenities, and absolute legal transparency. These elements not only protect money but also accelerate the asset's capitalization speed.

Legal viability is the foundation of any successful real estate operation. Before making any disbursement, it is imperative to verify the land use permits and current construction licenses. A robust legal security in investment structure protects your rights as a buyer and ensures that the deed process is smooth upon completion of the work. Clarity in contracts is the standard that defines industry leaders and eliminates uncertainty in the process.

Developer evaluation and compliance

Trust is built with facts, not commercial promises. Investigating the trajectory of a construction company involves reviewing its history of deliveries and the quality of its finishes in already inhabited projects. We recommend visiting previous works by the same group to verify the level of maintenance and the satisfaction of current residents. A developer's reputation is their most valuable asset; an impeccable track record is the best guarantee that your property will be delivered on time and in form, respecting every promised technical specification.

Amenities that guarantee profitability

Today's luxury market not only seeks square meters but also comprehensive wellness experiences. Differentiators that currently attract investors include wellness spaces, private pools, and 24/7 security systems with controlled access. In an environment where remote work is the norm, having coworking areas and high-speed connectivity immediately increases rental value. These features ensure that your investment stands out in a competitive market, attracting high-profile tenants who value exclusivity and harmony with the urban environment.

Investment comparison: Luxury apartments vs. Residential lots

Choosing between a high-end apartment and a residential lot is a strategic decision that must be based on your liquidity objectives and time horizon. While the best real estate pre-sales 2024 largely focused on the densification of exclusive areas, land has maintained a solid appeal for those seeking capitalization based purely on land value. The key lies in understanding how each asset behaves in the rental market and future resale.

In terms of liquidity, apartments are usually more agile. It is a finished product that responds to an immediate housing need, which facilitates its market entry. In contrast, residential lots require a buyer with a construction vision, which can lengthen sales times but usually offers higher profit margins due to the low initial investment. Regarding operation, an apartment entails maintenance fees, insurance, and services, while a residential lot has minimal carrying costs, allowing your capital to rest and grow with the environment.

Luxury apartments: The investor's favorite

The sale of luxury apartments has consolidated itself as the preferred option for those seeking recurring passive income. Thanks to vacation or long-term rental management models, you can delegate operational management and receive monthly profits with minimal effort. These developments, strategically located beachfront or in vibrant urban centers, offer vertical payment schemes that allow the down payment to be settled in installments during construction. This financial structure optimizes your cash flow, allowing you to acquire a high-value asset with a controlled initial investment.

Residential lots: Long-term capital gains

For those who prioritize asset growth over immediate cash flow, residential lots represent an exceptional entry opportunity. By acquiring land in pre-sale, you are "freezing" the price per square meter at an early stage of urban development. Architectural freedom in private communities with integral security allows you to design a personalized residence, which adds intangible value to the final project. Applying a "buy and hold" strategy in high-end land ensures that, by 2026, the value of your property reflects the consolidation of the surrounding infrastructure, becoming a highly coveted asset for its exclusivity and location.

Legal security: How to protect your pre-sale investment

Protecting your capital is as crucial as choosing the perfect location. When analyzing the best real estate pre-sales 2024, the difference between a successful investment and a financial conflict lay in the depth of legal due diligence. It is not enough to trust the commercial prestige of the developer. It is vital to verify that every sales promise is backed by a solid legal structure that guarantees the delivery of your assets.

Having specialized real estate legal advice allows identifying red flags before signing any document. An expert will review that the purchase agreement is not unilateral and that penalty clauses protect both parties equally. In the Mexican market, the validation of the Condominium Regime and the deed process are technical steps that require absolute precision to avoid unnecessary delays at the time of physical delivery.

Understanding the risks of investing in real estate pre-sales is the first step to mitigating them. Uncertainty about construction times or possible changes in final finishes can be resolved through well-structured contracts. Legal security is not an expense; it is the smartest investment you can make to ensure that your luxury apartment becomes a tangible and profitable reality.

Critical documentation you must demand

Before making any deposit, you have the right to request the complete legal file of the project. This transparency is the hallmark of serious developers. Be sure to receive and validate the following documents:

• Land deed: Verification of ownership and updated certificate of no encumbrances.
• Licenses and permits: Current construction license and environmental impact assessments approved by local authorities.
• Legal powers: Official identification and documents that prove the powers of the legal representatives to sign the contract.

Protection clauses for the buyer

The contract must be your shield. It is essential to include specific guarantees for hidden defects, establishing a period of builder responsibility after delivery. Likewise, the clauses must detail the exact specifications of finishes and materials, avoiding vague terms such as "similar quality." Finally, ensure that clear mechanisms exist for dispute resolution and automatic financial penalties in case the developer does not meet the agreed dates.

Frequently asked questions about pre-sale investments

What does it mean to buy in pre-sale and what are its benefits?

Buying in pre-sale means acquiring a property before its construction is finished or even before physical work begins. The main benefit is the preferential cost, as prices are usually considerably lower than upon completion of the project. Additionally, this modality allows you to choose the best locations within the development and offers flexible payment terms throughout the construction period.

Is it safe to invest in real estate pre-sales in Mexico?

It is a safe investment as long as it is done with reputable developers and under a legally sound contract. The best real estate pre-sales 2024 demonstrated that the Mexican market is resilient and offers robust legal guarantees for the buyer. To mitigate any risk, it is essential to have expert advice that validates the builder's background and the technical viability of the project before committing your capital.

How can I verify the legality of a pre-sale project?

You should request the land deed, the current construction license, and the updated certificate of no encumbrances. It is also necessary to review that the purchase agreement complies with local regulations and to validate the identity of the company's legal representatives. Total transparency on the part of the developer in providing this documentation is the first indicator that the project is legitimate and reliable.

What percentage of savings is obtained when buying in pre-sale vs. immediate delivery?

The average savings usually range between 15% and 30% of the property's final commercial value. This margin depends directly on the stage at which the purchase is made; the initial phases or "zero list" offer the most competitive discounts on the market. Upon completion of the work, the investor not only saved on the purchase price but also captured the capital gains generated throughout the construction process.

What are the most common risks and how to avoid them?

The main risks include delays in the delivery date, changes in finish specifications, or lack of liquidity from the developer. To avoid them, research the history of projects delivered by the construction company and visit their previous works to verify quality. Ensure that the contract includes clear penalty clauses for non-compliance and detailed descriptions of the materials and equipment to be used in your apartment.

Can I buy a real estate pre-sale with a bank loan or Infonavit?

Yes, it is possible, although the process varies depending on the financial institution and the progress of the work. Some banks offer specific pre-sale loans where funds are released according to construction milestones. In the case of Infonavit, there are programs designed for the acquisition of housing in authorized developments. We recommend consulting with a mortgage advisor to identify which institutions have direct agreements with the development of your interest.

What happens if the developer delays the delivery date?

The purchase agreement must specify automatic financial penalties for each month of delay after the agreed date. Generally, these penalties are applied as a monthly percentage of the total amount you have already paid. If the delay exceeds a defined grace period, you usually have the legal right to rescind the contract, demanding a full refund of your investment plus corresponding interest.

How is the return on investment calculated for a luxury apartment?

The return on investment (ROI) is calculated by adding the estimated annual capital gain to the net annual rental income, divided by the total acquisition cost. When evaluating the best real estate pre-sales 2024, we observed that luxury assets maintain higher capitalization rates thanks to their location and exclusive amenities. It is vital to consider operating costs such as maintenance and taxes to obtain a real and net profitability figure.
