Is it legal for a foreigner to buy property in Mexico?

Buying property in Mexico is an exciting decision and, above all, fully legal. The Political Constitution of the United Mexican States, in its Article 27, establishes the basis for any person, regardless of their nationality, to acquire real estate in national territory. This openness has made the country one of the most attractive destinations for international investment. However, the process has specific guidelines that depend on the geographical location of the property.

To understand why these rules exist, it is essential to review the history of land ownership in Mexico. This context explains the transition from traditional agrarian systems to the modern legal framework that now protects your investment. A recurring myth among buyers is the fear of arbitrary expropriation. The reality is different. In Mexico, private property enjoys robust legal protections; the government cannot revoke a property title without a justified cause of public utility and prior compensation, following processes similar to those in the United States or Canada.

Having real estate legal advice for foreigners is the first strategic step. An expert will help you distinguish between the two main areas of acquisition: the interior of the country and the so-called Restricted Zone. While the process is direct in the interior, a specific legal structure designed to provide absolute legal certainty to international buyers is used on the coasts and borders.

The Calvo Clause and its legal security

When you begin your procedure with the Ministry of Foreign Affairs (SRE), you will encounter the Calvo Convention. Do not be alarmed by the technical term. It is a standard requirement where you agree to be considered a Mexican national solely with respect to the property you are acquiring. This means you commit to resolving any legal dispute over the property before Mexican courts, without invoking the protection of your foreign government. It is a pact of respect for local sovereignty that, at the same time, grants you the same rights and obligations as any Mexican citizen over your assets.

Areas where you can buy directly

If the house or apartment of your interest is located outside the Restricted Zone (more than 50 kilometers from the coasts and 100 kilometers from the borders), you can acquire it through a direct deed. In these regions, the process is extremely agile. You will be the sole owner in the Public Registry of Property. Basic requirements usually include:

• Valid passport as official identification.
• Legal migratory status (either as a tourist, temporary, or permanent resident).
• Signing of the acquisition permit before the SRE.

Your investment is secure. At eXp Realty Riviera Maya, we understand that clarity is the foundation of trust. Therefore, we position legal verification as the cornerstone of every transaction, ensuring that your path to property ownership in Mexico is transparent and successful.

The Fideicomiso (Trust) and the Restricted Zone: What you need to know

The Mexican coast offers unparalleled landscapes, but its geographical location imposes specific rules that every investor must know. The so-called Restricted Zone comprises a strip of 50 kilometers along the beaches and 100 kilometers along the land borders. If your interest is focused on acquiring a beachfront apartment or a residence near the coast, the bank Fideicomiso (Trust) is the legal instrument that guarantees your security. This tool is not an obstacle; it is a protection mechanism designed to ensure your investment has the full backing of Mexican law.

Through this contract, a Mexican bank acts as a trustee, holding the technical title to the property, while you are the fideicomisario or primary beneficiary. This grants you absolute control over the real estate. You have the legal right to sell the property, rent it to generate investment returns, inherit it to your loved ones without the need for complex probate proceedings, or carry out any desired renovations. In 2026, these contracts remain valid for 50 years and are perpetually renewable, ensuring your assets remain secure in the long term. Obtaining real estate legal advice for foreigners is vital to correctly draft the substitute beneficiary clauses and avoid future complications.

What exactly is a bank Fideicomiso (Trust)?

Imagine the Fideicomiso (Trust) as a bank safe deposit box where your property title is kept. The bank is the custodian of that box, but you are the only one who holds the keys and decides what to do with what's inside. The bank cannot dispose of the property or encumber it for its own debts; its function is purely administrative and for legal protection. For the year 2026, the cost for issuing the permit before the Ministry of Foreign Affairs (SRE) is $21,650.00 MXN. Additionally, consider an initial opening investment of between $50,000 and $80,000 MXN, with an annual maintenance fee ranging from $15,000 to $25,000 MXN, depending on the chosen banking institution.

Acquisition through a Mexican corporation

There are cases where creating a Mexican company with foreign capital is the most efficient route. This option is ideal if you plan to acquire multiple properties or if the property will have a purely commercial use, such as a hotel or a business premises. Unlike the residential Fideicomiso (Trust), corporations can directly own land in the Restricted Zone for non-residential purposes. However, this entails stricter tax obligations with the SAT and requires detailed monthly accounting. Legal requirements for foreigners buying in Mexico

Acquiring property in Mexico is a structured process that demands documentary precision to guarantee the validity of your investment. The first step is to have a valid official identification, with the passport being the primary document. In addition, your migratory status, whether as a tourist or resident, must be duly accredited. In this scenario, real estate legal advice for foreigners becomes your best ally to coordinate obtaining the permit from the Ministry of Foreign Affairs (SRE), an indispensable requirement to formalize the purchase anywhere in the national territory.

A central player in this process is the Public Notary. Unlike other countries, in Mexico, the Notary is a lawyer vested with public faith by the State, responsible for validating the legality of the entire transaction. Their work includes verifying that the seller has the legal authority to alienate the property and ensuring that the corresponding taxes are withheld and paid correctly. Without the Notary's signature and seal on the deed, the property cannot be registered in the Public Registry of Property, which is the final and definitive proof of your ownership before third parties.

Step by step: From promise to deed contract

The path to your new property usually begins with a promise to purchase agreement. This document establishes the price, deadlines, and delivery conditions. During this stage, it is crucial to carry out an exhaustive Due Diligence process, where the Certificate of No Encumbrances is verified to confirm that the property has no pending mortgages or tax debts. Once this phase is completed, the public deed is signed before the Notary. At this point, you must cover the notarial fees, which usually range between 0.7% and 1.5% of the property value, and the Property Acquisition Tax (ISAI), which in high-demand areas varies between 3% and 4% depending on the specific location.

The importance of the RFC for foreign buyers

Even if you do not plan to reside permanently in the country, obtaining the Federal Taxpayer Registry (RFC) is an essential requirement in 2026. This tax identification number is requested by Notaries to register the transaction and is fundamental for your future tax obligations. Having an RFC will allow you to correctly comply with tax payments in case of generating rental income or, critically, to calculate the Income Tax (ISR) when you decide to sell the property. Not having this registration could result in automatic tax withholdings of 25% on the total sale price, instead of paying on the net gain. At eXp Realty Riviera Maya, we facilitate connection with expert accountants who streamline this process, ensuring that real estate legal advice for foreigners covers every angle of your financial and legal security.

Secure Investments: How to avoid real estate risks

Legal certainty is the foundation of any successful investment, especially when dealing with cross-border assets. In the Mexican market, the excitement of acquiring a luxury apartment or a beachfront lot can cloud critical judgment if you do not have the right guidance. Therefore, real estate legal advice for foreigners should be your first line of defense. It's not just about buying a property, but about acquiring the certainty that your assets are protected against any legal or financial eventuality.

One of the biggest risks lies in private contracts that are not reviewed by a Public Notary. In Mexico, a simple contract between individuals has limited validity against third parties and is not sufficient to prove ownership to the authorities. Without ratification before a public faith authority, you lack the maximum protection offered by the registry system. To mitigate risks, the use of Escrow accounts has become a security standard. These accounts, managed by neutral third parties, ensure that funds are only released when specific legal milestones are met, such as the delivery of physical possession or the signing of the public deed.

Due Diligence: The indispensable prior investigation

Before transferring any deposit, it is vital to conduct a thorough audit of the property. You must demand from the seller the original property title, the last paid property tax receipt, and the updated Certificate of No Encumbrances. In the case of pre-sale developments, verify that the company has the correct land use and valid construction licenses. Detecting 'hidden legal defects', such as unfinished probate proceedings or mortgages not canceled in the registry, requires an expert eye. At eXp Realty Riviera Maya, we prioritize this exhaustive verification to ensure that every property in our catalog meets the highest standards of transparency and legality.

Title insurance in Mexico: Is it necessary?

Many international investors are familiar with Title Insurance. In Mexico, the public faith of the Notary fulfills the primary validation function, but private insurance from international companies can offer an additional layer of peace of mind. This service is recommended for high-value transactions or on land with complex ownership histories. While the Notary validates the legality of the present act, title insurance protects against future claims arising from past errors or identity fraud. Evaluating this option with your advisor will allow you to make an informed decision, knowing that your investment is protected on multiple fronts.

Frequently asked questions about real estate investments

Can a foreigner inherit property in Mexico without legal complications?

Yes, it is possible to inherit easily if you designate substitute beneficiaries directly in your Fideicomiso (Trust) contract. Mexico does not apply an inheritance tax, which greatly facilitates asset transfer. Upon the death of the holder, beneficiaries assume legal control without the need for prolonged probate proceedings. They will only need to cover the local acquisition tax payment to definitively register the property in their name.

How long does the legal purchase process take for a foreigner?

The process usually takes between 45 and 90 calendar days from the signing of the promise to purchase agreement to the closing before a notary. This period includes obtaining the permit from the Ministry of Foreign Affairs and managing the bank Fideicomiso (Trust). Having real estate legal advice for foreigners streamlines these times, as it allows for efficient coordination of all involved parties and avoids errors in technical documentation.

Is it mandatory to have temporary or permanent residency to buy a house?

It is not mandatory to be a legal resident; you can acquire property in Mexico by entering with a tourist visa. However, to formalize the deed in 2026, the tax system requires you to have a Federal Taxpayer Registry (RFC). This identification number is indispensable for the Public Notary to process tax payments and correctly register the property with the corresponding Mexican authorities.

What happens if the bank holding my Fideicomiso (Trust) goes bankrupt or disappears?

Your investment remains fully protected because the assets in a Fideicomiso (Trust) do not form part of the bank's assets. If the fiduciary institution faces financial problems or goes bankrupt, the National Banking and Securities Commission will designate another bank to assume the administration of your contract. Your rights as the primary beneficiary are inalienable, and the property title remains safeguarded under the same original legal framework.

What are the typical closing costs for a foreign buyer in Mexico?

Closing costs generally range between 4% and 6% of the property value. This item includes the Property Acquisition Tax, which in high-demand areas is between 3% and 4%, and notarial fees. You must also add the cost of the SRE permit, which in 2026 is $21,650.00 MXN, in addition to the initial opening expenses of the bank Fideicomiso (Trust).

Can I buy property in Mexico in the name of my minor children?

It is feasible to make the purchase in the name of minors, although it requires parents to act as their legal representatives throughout the process. This legal structure must be clearly defined in the public deed or in the Fideicomiso (Trust) contract. It is a decision that must be carefully analyzed from a fiscal perspective, as it implies specific legal commitments regarding the administration of the asset until the children reach legal age.

What annual taxes do I have to pay for owning property in Mexico?

The main tax is the Predial (property tax), which is extremely affordable and paid directly to the municipality. The annual rate usually varies between 0.1% and 0.3% of the cadastral value of the property, which is very competitive compared to other international markets. Many municipalities offer significant discounts, up to 20%, if you make the payment in advance during December or January of each year.

Do I need to travel to Mexico physically to sign the deeds?

It is not strictly necessary to travel to the country to conclude the legal transaction. You can grant a Power of Attorney to a trusted representative or to your real estate legal advice team for foreigners. This power must be signed before a Mexican consul in your country of origin or duly apostilled. In this way, your representative can appear before the Public Notary in Mexico to sign the final deed on your behalf.
